General Terms of Service for the Falcons Sports Program System

Welcome to the Falcons Sports Program system (the “System”), operated by Coastline LLC (“we,” “us,” or “our”). These General Terms of Service (“Terms”) govern your access to and use of the System, including our web application available at falcons.coastline-fm.com, and related services. By accessing or using the System, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the System.

1. Account Creation and Use:

  • You must create an account to access the System. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must provide accurate and complete information when creating your account.
  • You may not use the System for any illegal or unauthorized purpose.
  • You may not impersonate any other user or misrepresent your affiliation with any person or entity.
  • You are responsible for all content you post or otherwise transmit through the System.
  • For underage participants: minimum age for enrolment is 3 years old for Gymnastics, 4 years old for Taekwondo, 5 years old for Football, Swimming, Basketball, Tennis and Badminton. The maximum age for enrolment is up to 17 years. Any participant of age 18 and above is considered to be in the adult age group.

 

2. User Content:

All content submitted to the system, such as participant information, dependent information, etc is the sole responsibility of the user who submitted it. We do not endorse or control the content submitted by users.

3. Program Registration and Payment:

  • Program registration requires payment of fees. You agree to pay all applicable fees for any programs you register for.
  • Payment can be made online using credit card, mada or Apple Pay via the payment link that will be sent to your email address after successful registration, (or) in-person cash or card, at the reception of any of the recreation centers (Harbor Sports Club, Island Recreation Center, Racquet Club).
  • Payments must be finalized within three days of receiving the payment link. Failing to pay before the link expiry date will cause the participants to lose their spot in the program.
  • We reserve the right to change program fees at any time.
  • Re-registrations for previous participants will be automatic after a new term is created and payment links are sent out immediately.
  • Head Coaches will evaluate and determine the participants’ placements according to their level of performance.
  • Change of participant schedule for any activity during the term is not allowed unless agreed by our management for exceptional cases.
  • Refunds, if applicable, will be governed by our refund policy, which is available below.

 

4. Refund Policy:

Refund available for sessions related to the following below guidelines:

  • Final-exit from Saudi Arabia permanently during active term.
  • In case of pandemic or general shut down, sessions purchased but not completed, will be refunded.
  • Unable to continue training sessions due to injury supplemented with a medical report.

If one of the above-mentioned conditions is met, the refunded amount will be prorated according to how many weeks are remaining in the month as of the date of the refund request. Request for prorated refund must be done before the originally scheduled and paid for sessions end.

  • In cases of missing training sessions, the participants will not be entitled to any make-up sessions, unless the cancellation was authorized by KAUST Falcons Sports programs’ management. Yet, in presence of an availability in an alternative group, Head coaches can deliver make up sessions and an appropriate email will be sent with the update.
  • Any cancellation from a participant’s side won’t necessarily result in a financial refund.
  • Missed classes are considered consumed unless medical related concerns are supported by Medical Notes.
  • Any administration or financial issues shall be coordinated with KAUST Falcons Management.
  • Make up sessions for cancelled classes will be at the discretion of the Recreation Management. Failure to attend the make-up session will result in forfeiting the session credits.

 

5. Conduct:

  • You agree not to:
    • Use the System in any way that violates any applicable law or regulation.
    • Interfere with or disrupt the System or its servers.
    • Attempt to gain unauthorized access to any part of the System.
    • Impersonate any other user or misrepresent your affiliation with any person or entity.
    • Harass, threaten, or intimidate other users.
    • Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable.
    • Use the System for any commercial purpose without our prior written consent.

 

6. Intellectual Property:

  • The System and its content, including but not limited to text, graphics, logos, trademarks, and software, are owned by us or our licensors and are protected by copyright and other intellectual property laws.
  • You may not use any content from the System without our prior written consent.

 

7. Disclaimer of Warranties:

  • The System is provided “as is” and “as available” without any warranties of any kind, either express or implied.
  • We do not warrant that the System will be uninterrupted, error-free, or secure.
  • We do not warrant the accuracy, completeness, or reliability of any content on the System.

 

8. Limitation of Liability:

  • To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the System.
  • Our total liability to you for any claim arising out of or related to these Terms or the System will not exceed the amount you have paid us in the past twelve (12) months.

 

9. Indemnification:

  • You agree to indemnify and hold us harmless from any claims, damages, or expenses (including attorney’s fees) arising out of or related to your use of the System or your breach of these Terms.

 

10. Termination:

  • We may terminate your access to the System at any time, with or without cause, without notice.

 

11. Governing Law:

  • These Terms will be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.

 

12. Entire Agreement:

  • These Terms constitute the entire agreement between you and us regarding the System and supersede all prior agreements and understandings.

 

13. Changes to these Terms:

  • We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the System. Your continued use of the System following the posting of the updated Terms constitutes your acceptance of the changes.
